Terms of Service

1. Acceptance

These Terms of Service (“Terms”) form a binding agreement between you and MIOPS TEKNOLOJİ ANONİM ŞİRKETİ (“MIOPS”, “we”, “us”), a company registered in Türkiye. By downloading, installing or using Photo Expert (the “App”), you accept these Terms and our Privacy Policy. If you do not accept them, do not use the App.

You must be at least 13 years old, and old enough to form a binding contract where you live, to use the App.

2. Licence

MIOPS grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use one copy of the App on Apple devices you own or control, in accordance with the Apple Media Services Terms and these Terms.

You may not:

• copy, modify, translate or create derivative works of the App, except as permitted by law;
• reverse engineer, decompile or disassemble the App, or attempt to derive its source code;
• rent, lease, lend, sell, sublicense or otherwise transfer the App;
• remove or obscure any proprietary notice; or
• use the App to build a competing product or service.

3. Your account

The App is fully usable as a guest. If you choose to create an account, you may sign in with Google, Apple, Facebook or GitHub. You are responsible for maintaining control of the identity provider account you sign in with, and for all activity that occurs under your Photo Expert account.

Tell us immediately at info@miopsteknoloji.com if you suspect unauthorised access. You may delete your account at any time from Profile → Account → Delete account in the App; see our Privacy Policy for what that erases.

4. Subscriptions & payment

Photo Expert offers optional premium features through auto-renewing subscriptions and one-time purchases, sold and processed exclusively by Apple through the App Store. MIOPS never sees your payment card details.

• Billing. Payment is charged to your Apple Account at confirmation of purchase.
• Renewal. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours of the period ending.
• Managing. Manage or cancel your subscription in Settings → your name → Subscriptions on your device. Deleting the App does not cancel a subscription.
• Free trials. Any unused portion of a free trial is forfeited when you buy a subscription covering the same period.
• Refunds. Refunds are governed by Apple's policies. Request one at reportaproblem.apple.com. MIOPS cannot issue App Store refunds directly.
• Price changes. We may change prices. Changes apply to renewals only after we have given you notice, and you may cancel before they take effect.

5. Acceptable use

You agree not to:

• use the App for any unlawful purpose, or in violation of any local, national or international law;
• interfere with, disrupt or place undue load on our servers or networks;
• probe, scan or test the vulnerability of our systems, or breach any security or authentication measure, without our written permission;
• access the App by automated means, scrape it, or resell data obtained from it;
• impersonate any person, or misrepresent your affiliation with any person or entity; or
• upload or transmit malware, or content that infringes the rights of others.

6. Camera triggers & hardware

The App can connect over Bluetooth to MIOPS SMART+ and compatible camera triggers, control their modes, and install firmware updates. You are responsible for your camera, lenses and any equipment connected to them.

Firmware updates carry risk. Do not disconnect the device, close the App or let either device lose power during an update. MIOPS is not liable for a device rendered inoperable by an interrupted update, by third-party firmware, or by use outside the device's documented operating conditions. Hardware warranty terms are those supplied with the hardware.

7. Accuracy & safety

You are solely responsible for your own safety and for complying with the law at any location you visit — including trespass, permits, national park rules, drone regulations, curfews and restricted airspace. Verify local conditions, tides, terrain and weather independently before travelling, and never rely on the App as your only source of safety-critical information.

8. Intellectual property

The App, its source code, design, text, graphics, the Photo Expert and MIOPS names and logos, and all related intellectual property, are owned by MIOPS or its licensors and are protected by copyright, trademark and other laws. These Terms grant you a licence to use the App — not any ownership in it.

Content you create in the App — plans, notes, saved locations, your camera bag — remains yours. You grant MIOPS a limited licence to store, process and transmit it solely to operate the service for you.

The App includes third-party open-source components. Their licences are reproduced in the App under Profile → Licences and govern your use of those components.

9. Third-party services

The App integrates services operated by others — including Google Maps, Google Sign-In, Firebase, Adapty, Mixpanel and weather data providers — and links to sites we do not control, such as our Help Center and feedback board. Your use of those services is governed by their own terms and privacy policies. MIOPS is not responsible for their content, availability or practices.

10. Termination

You may stop using the App at any time and delete your account. We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to by law, or if we discontinue the App. Sections 7 through 14 survive termination.

11. Disclaimer of warranties

The App is provided “as is” and “as available”, without warranty of any kind. To the fullest extent permitted by law, MIOPS disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that its calculations, forecasts or recommendations will be accurate.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, MIOPS and its directors, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for lost profits, lost data, missed photographs, damaged equipment, personal injury, or the cost of substitute services, arising out of or relating to your use of the App — whether based in contract, tort, negligence, strict liability or otherwise, and even if we were advised of the possibility.

Our total aggregate liability for all claims relating to the App is limited to the greater of (a) the amount you paid us for the App in the twelve months before the event giving rise to the claim, or (b) fifty euros (€50).

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

13. Apple-specific terms

These Terms are between you and MIOPS, not Apple. Apple is not responsible for the App or its content. You additionally acknowledge that:

• Apple has no obligation to furnish any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claim by you or a third party relating to the App, including product liability, regulatory non-compliance, or consumer protection claims.
• Apple is not responsible for the investigation, defence, settlement or discharge of any third-party intellectual property infringement claim relating to the App.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government prohibited-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The courts and enforcement offices of İstanbul (Çağlayan) have exclusive jurisdiction over any dispute.

If you are a consumer resident in the European Union, the United Kingdom or Türkiye, you keep the benefit of any mandatory consumer-protection provisions of the law of your country of residence, and you may bring proceedings in your local courts.

If any provision of these Terms is held unenforceable, the remainder stays in force. Our failure to enforce a provision is not a waiver of it.

15. Changes

We may revise these Terms. When we make material changes we will update the effective date above and notify you in the App or by email before they take effect. If you keep using the App afterwards, you accept the revised Terms.
